Half.com shipping refund?

I ordered a game from a seller on half.com. They listed it as "like new" and claimed the discs were flawless. Anyways, I got the game (Final Fantasy VII) but it was missing the instruction manual. Half's policy for listing Items as "like new" require that the item comes with all the inserts one would find when purchased new. That's not the worst part. The first disc had quite a few scratches. It stopped working not long into the game. Long story short, I asked to return it but the seller said if I did they wouldn't refund the shipping it cost them to send it to me. Can they do that? Since they sold the defective item shouldn't they be the one paying for the shipping? I skimmed through half's return policy but I didn't see anything about it. I must have missed it. Is the seller required to refund the shipping cost?

I don't know..but I would return it anyway, and not buy anything more from that seller... and if there is a place for feedback...I would leave that story there......
